Regulatory Framework: Hash Holes Legal Regulations

First, let’s start with the regulatory bodies, a.k.a, some of the main decision-makers for cannabis usage. In the USA, there are several cannabis regulatory agencies. They are divided into three levels: federal, state, and tribal.

The group of federal cannabis regulatory agencies includes:

On a state level, there are many cannabis regulatory agencies throughout the USA. Understandably, each one is responsible for the hash hole legal regulations in the state in which it operates.

Some examples of state-operating cannabis regulatory agencies are the California Bureau of Cannabis Control, Colorado Department of Revenue, Connecticut Department of Consumer Protection, etc.

Cannabis legalization

In the U.S., there is one main federal law, and each of the states has their own state laws. According to the Controlled Substances Act, marijuana is considered a Schedule I substance. In simpler words, under federal law, marijuana has a high potential for abuse, making it illegal to use.

However, many states in the US have allowed the use of marijuana for medical and/or recreational use. The regulations on a state level have to go through several steps, which make the rulemaking process.

Legal status of doughnut joints

A factor to consider before starting to produce hash holes is that you should first check the hash hole legal regulations in your state, as presented in the table above.

For example, in states like Alaska and the District of Columbia, you are not allowed to possess hash or any concentrates. Since the core of the hash hole is the hash or other concentrate placed in the middle like rosin, you won’t be able to roll and consume hash holes legally in these two states.

Age Restrictions

All states that allow recreational and medical use of marijuana and marijuana-based products have age restrictions regulations. This is one of the ways for the states to ensure that cannabis is used responsibly.

The age restriction in all states is 21 years. The reason behind this decision is to prevent underaged individuals from experiencing negative side effects. A study about the effects of cannabis in adolescents and adults showed that adolescent users might experience poorer cognitive recovery.

The age restriction applies to both consumption and purchasing. If you are younger than 21 years, you won’t be able to buy a hash hole or donut pre-roll. When you visit websites selling hash holes, you must confirm you are 21 or above before you browse the products.

The penalties for possessing or consuming marijuana products when under the age of 21, including hash holes, might be considered a misdemeanor or a felony. The consequences an underage individual could face depend on state regulations.

Here are some examples of how states in the US treat underage consumption and possession of marijuana products.

  • Virginia – civil penalty of no more than $25 and substance abuse treatment or educational program required

  • Washington – maximum 364 days imprisonment, up to $5,000 fine, possible driving license suspension

  • Oregon – class A misdemeanor or Class C felony, depending on the amount possessed

Packaging and Labeling

The hash holes legal regulations regarding the packaging and labeling also differ according to the state. However, according to a study, the most common requirements are the following:

  • Cannabis symbol

  • THC and CBD content

  • Cannabinoid content

  • Potency statement

  • Nutrition panel

  • Testing facility

  • Health risks

  • Impairment disclaimer

  • Children disclaimer

  • Manufacturer contact

  • Production tracking

  • Net weight

  • Batch number

Another important thing is that the packaging must be child-resistant. In addition, the packaging should be tested by independent child-resistant package testing firms.

Marketing and Advertising

Although cannabis products are illegal on a federal level, there is no federal policy concerning marketing and advertising. Among the 31 states that allow some consumption of cannabis products:

  • 74% of these states forbid companies in the cannabis industry to target minors in their marketing strategy

  • 68% don’t allow making misleading or false claims

  • Approximately half regulate where cannabis product advertisements can be placed

  • 42% of the states restrict building signage

There are also strict hash holes legal regulations that require including certain warnings in the advertisement. They generally differ according to the channel the product will be advertised on.

Taxation

Taxation of cannabis products, including hash holes, is different from state to state in the USA. The biggest difference is in how much companies are taxed.

State Wholesale tax rate Retail tax rate
Colorado 15% 15%
Washington 37% 37% at retail, 6.5% sales
Nevada 15% 10% special retail, 6.85% standard sales tax
Illinois 7% 10-25% retail depending on potency, 6.25% standard sales tax
Maine $335 per pound of flower 10% sales tax

All states in the US have gotten $3.77 million in taxes from cannabis-based products. In fact, the share of the individual state’s tax revenue generated from cannabis excise taxes typically ranges between 0.4% and 1.7%

To illustrate, in the fiscal year of 2022, California has collected a whopping $774.4 million by taxing cannabis products. You might ask, how is the money collected from taxes used?

Well, most of the states fund specific spending programs from the cannabis tax. For example, Arizona dedicates one-third to community colleges, Colorado uses it to build public schools, and Washington spends 50% on health care programs.

Also, states like New York, New Jersey, and Massachusetts spend a portion on programs for the development of communities suffering from drug abuse.

Revenue

All companies in the US cannabis industry collect revenue from three main sources: medical, recreational, and therapeutic cannabis usage. However, the biggest portion of it is from recreational cannabis consumption.

In 2022, companies in the US had a collective revenue of over $28 billion, of which $15.37 billion was from recreational cannabis. As for the sales of cannabis products, flower is the most popular, but pre-rolls have noticed an increase from $1.6 billion in 2020 to $2.8 billion in 2022.

The estimations are that companies working in the cannabis industry will generate over $67 billion in revenue by 2028 from all types of cannabis products.

What Might Change in 2023?

In most of the US states where there is no law for decriminalizing or legal cannabis consumption, reforms can be made only via the state’s legislature. Here are the newest changes in state regulations that happened in 2023:

  • Kentucky allowed medical use of cannabis

  • Delaware and Minnesota legalized adult-use of cannabis

  • Maryland legalized sales of cannabis for adult use

Some of the states that have effective medical cannabis bills that might result in a law are:

  • Georgia

  • Indiana

  • Kansas

  • Nebraska

  • North Carolina

  • South Carolina

  • Tennessee

Also, five states currently have bills to remove possible jail time for simple possession. In other words, they are trying to decriminalize the possession of cannabis:

  • Alabama

  • South Carolina

  • Texas

  • Tennessee

  • West Virginia

Conclusion

Not only is the cannabis industry fast-growing, but also the US states are voting laws to decriminalize or make cannabis usage legal. Because of that, understanding your state's hash holes legal regulations is crucial for you as a consumer.

Always keep in mind that in states where recreational cannabis is allowed, one must be 21 years or older to start using it.

To roll a hash hole by yourself, you need cannabis flower and hash or other concentrate like rosin. You should ensure the amount you have at home is according to the regulations of the law. Double-check if your state allows cannabis consumers to use hash and concentrates.

Consume responsibly!
